These Terms of Service (“Terms”) govern your access to and use of the KESSLER U.S. online store available at kesslergloves.com (the “Site”) and any related services (collectively, the “Services”). The Services are operated by Otto Kessler USA, Inc. (“KESSLER,” “we,” “us,” or “our”).

By using the Services or placing an order, you agree to be bound by these Terms. For enforceability under U.S. law, we will ask you for affirmative acceptance (clickwrap) at checkout.

1. Eligibility & Use of the Services

You must be at least 18 years old (or the age of majority where you live) to use the Services. By using the Services, you represent that you meet this requirement and that any information you provide is accurate.

2. Orders & Contract Formation

Placing Orders. When you place an order, you are making an offer to buy products under these Terms.
Order Confirmation. We will send an order confirmation email acknowledging receipt. This does not mean your order is accepted.
Acceptance. Your order is accepted once we (a) ship the products and/or (b) send a shipping confirmation. We may refuse or cancel orders at our discretion (e.g., suspected fraud, pricing errors, stock issues).

3. Prices, Taxes & Payments

Prices. Prices are shown in U.S. dollars unless stated otherwise.
Sales Tax. We collect sales tax where required by law. The final tax amount is shown at checkout and depends on your shipping address.
Payment Method. We accept PayPal. Your payment is processed by PayPal under their terms and privacy policy.
Pricing Errors. If a product is listed at an incorrect price, we may cancel the order and refund you.

4. Shipping, Delivery & Risk of Loss

Shipping. We ship to U.S. addresses using our fulfillment and carrier partners.
Delivery Times. Estimated delivery windows shown on the Site are not guarantees.
Risk of Loss / Title. Risk of loss passes to you upon delivery to the carrier, to the extent permitted by law.
Partial Shipments. We may ship items separately.
Address Accuracy. You are responsible for providing a valid shipping address.

5. Returns & Refunds

We understand that sometimes a product may not meet your expectations. Returns and refunds for purchases made through our U.S. online store are handled in accordance with the guidelines below, which reflect the return policy available on kesslergloves.com and are part of these Terms.

5.1 Return Eligibility & Timeframe

You may return products within thirty (30) days from the date you receive your order due to non-satisfaction or fit issues, in keeping with our Return Guidelines.
Returned products must be in original packaging, with all tags attached, unused, and in unwashed/unworn condition.

5.2 Return Shipping & Costs

Unless otherwise required by applicable law, return shipping costs are the responsibility of the customer.
The cost of return shipping may be deducted from your refund amount where permitted.

5.3 Return Process

To start a return, please follow the instructions on the Return page of our website.
You may obtain a prepaid return label if such an option is provided on our Returns page.
We recommend using a trackable shipping method and retaining your shipment receipt until the refund is completed.

5.4 Refunds

Once your return arrives at our facility and is inspected, we will issue a refund via the original payment method (e.g., PayPal).
Refunds are typically processed within two (2) business days after the returned goods are received in acceptable condition.
Original shipping charges are non-refundable, unless required by law.

5.5 Exclusions

Products that are not in their original condition, that have been worn or altered, or missing tags/packaging may not be eligible for a refund.

6. Product Information

We try to display products accurately (colors, materials, sizing). However, screen settings and minor production variations may cause differences. Product descriptions are not warranties.

7. Promotions & Gift Cards

If we offer promotions, discount codes, or gift cards, they are subject to additional terms disclosed at issuance. We may modify or cancel promotions at any time unless prohibited by law.

8. Warranty Disclaimer & Limitation of Implied Warranties

Important: This section is intended to be conspicuous, as required under U.S. law.

No Express Warranty Unless Stated. Unless we provide a written warranty for a specific product, the Services and products are provided “AS IS” and “AS AVAILABLE.”
Implied Warranties. To the fullest extent permitted by law, we disclaim all implied warranties, including the implied warranties of merchantability and fitness for a particular purpose.
State Law Rights. Some states do not allow disclaimers or limitations of implied warranties, so the above may not apply to you. In those states, warranties are limited to the minimum required by law.

Magnuson-Moss Notice: If we provide a written warranty for any consumer product, it will be designated as “full” or “limited” and described on the product page or enclosed with the product, consistent with federal warranty law.

9. Limitation of Liability

To the fullest extent permitted by law:

No Indirect Damages. KESSLER will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages.
Liability Cap. KESSLER’s total liability for any claim relating to the Services or products will not exceed the amount you paid for the product(s) giving rise to the claim.
State Law Rights. Some states do not allow limitations of liability for certain damages; in that case, our liability is limited to the minimum extent allowed.

10. Indemnification

You agree to indemnify and hold harmless KESSLER, its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services or violation of these Terms.

11. Intellectual Property

All content on the Site (text, images, logos, product designs, trademarks, and software) is owned by or licensed to KESSLER and is protected by intellectual property laws. You may not use our content without prior written permission.

12. User Content (if applicable)

If the Site allows reviews or other user submissions:

You grant KESSLER a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for operating and promoting the Services.
You represent that your content is accurate, lawful, and does not infringe third-party rights.
We may remove content at our discretion.

13. Privacy

Your use of the Services is subject to our U.S. Privacy Policy, which explains how we collect, use, and share personal information.

14. Dispute Resolution; Governing Law

Governing Law. These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules, and applicable U.S. federal laws.
Venue. Unless arbitration is elected (see below), you agree that disputes will be brought in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction there.

15. Force Majeure
